After the Los Angeles County District Attorney refused to file charges against Oscar Carrillo-Gonzales, he is now in the hands of federal agents.
U.S. Immigration and Customs Enforcement (ICE) lodged an immigration detainer against Oscar Carrillo-Gonzalez on March 28 following his incarceration at the Pasadena City Jail. A check of ICE’s databases revealed that Carrillo was previously removed from the United States to Mexico in April 2006. ICE is focused on smart, effective immigration enforcement that prioritizes efforts to identify and remove criminal aliens who pose a public safety risk as well as individuals who exploit our immigration system, such as immigration fugitives and others who have been previously deported and illegally re-entered the United States.
An immigration detainer is a notice that ICE issues to federal, state and local law enforcement agencies (LEAs) to inform the LEA that ICE intends to assume custody of an individual in the LEA’s custody. An immigration detainer serves three key functions: 1) to notify an LEA that ICE intends to assume custody of an alien in the LEA’s custody once the alien is no longer subject to the LEA’s detention; 2) to request information from an LEA about an alien’s impending release so ICE may assume custody before the alien is released from the LEA’s custody; and 3) to request that the LEA maintain custody of an alien who would otherwise be released for a period not to exceed 48 hours (excluding Saturdays, Sundays, and holidays) to provide ICE time to assume custody.
Carillo – Gonzales is accused of making the fake 9-1-1 call that resulted in the officer involved death of Kendrec McDade.
It was the arrest of Oscar Carrillo Wednesday by Pasadena police on suspicion of involuntary manslaughter which led ICE officials to check the 26-year-old Pasadena man’s legal status.
